Intellectual Property Policy Committee is a Vice-Chancellor's committee established in accordance with Council Procedure 1 - Committees . Intellectual Property Policy Committee is accountable to the Deputy Vice-Chancellor (Research and Commercialisation) for fulfilling the following terms of reference.

Terms of reference

Intellectual Property Policy Committee:

  • provides advice to the Deputy Vice-Chancellor (Research and Commercialisation) on policy relating to intellectual property generally, including strategic positioning of the University, and the implementation of this policy in relation to specific matters;
  • provides policy advice to the Deputy Vice-Chancellor (Research and Commercialisation) in relation to protection of exploitable intellectual property by best commercial practice;
  • at the request of the Deputy Vice-Chancellor (Research and Commercialisation), may undertake studies on the impact of the intellectual property policy on students;
  • monitors the external legislative environment, including impending legislation and developments in international legislation, and advises the Deputy Vice-Chancellor (Research and Commercialisation) accordingly;
  • assists the Deputy Vice-Chancellor (Research and Commercialisation) in the resolution of any complaint made by any creator pursuant to QUT's intellectual property policy (see D/3.1 );
  • reports annually, and on an ad hoc basis as required, to University Academic Board. Annual reports shall incorporate relevant matters as identified by University Research and Innovation Committee and University Teaching and Learning Committee and should include measures of performance and effectiveness of QUT's intellectual property policy, including:
    • the number of patents taken out and the number of these taken up for exploitation;
    • the number of circuit layouts, eligible layouts, designs, plant varieties or trademarks registered under the relevant legislation and details relating to the exploitation of any of these;
    • the amount of income in cash or kind received by QUT and creators subject to QUT's intellectual property policy through the exploitation of QUT intellectual property or other intellectual property which is the subject of contracts with QUT for sponsorship of research and scholarship;
    • the expenditure incurred by QUT in endeavouring to protect and/or exploit intellectual property;
    • the sale of products or processes arising from QUT intellectual property or other intellectual property which is the subject of contracts with QUT for sponsorship of research and scholarship

These reports should not contain details relating to individual items of intellectual property.

In undertaking its duties Intellectual Property Policy Committee may confer with any person, including the Commercial Services Director, or the Copyright Officer, or the creator of any intellectual property at issue.

Within the bounds of statutory obligations (including Freedom of Information legislation), proceedings and papers of Intellectual Property Policy Committee, at the discretion of the Chair, must be kept strictly confidential. The Chair may require members of Intellectual Property Policy Committee to sign confidentiality undertakings.

Membership

  • Deputy Vice-Chancellor (Research and Commercialisation) or nominee as Chair
  • Executive Dean, Faculty of Law, or nominee
  • Two academic staff members elected by and from the University's academic staff
  • Two nominees of the Deputy Vice-Chancellor (Research and Commercialisation) who have expertise in the protection and/or commercialisation of intellectual property, one of whom must be from outside QUT
  • One nominee of University Research and Innovation Committee nominated by and from University Research and Innovation Committee
  • One post-graduate student nominated by the Vice-Chancellor
  • One nominee of University Teaching and Learning Committee

A nominee of the Registrar is secretary.

It is expected that the Commercial Services Director and the Copyright Officer will attend the Committee when it is considering items relevant to their portfolios

Tenure and frequency of meeting

Terms of office are as detailed in section 3 of Council Procedure 1 - Committees .

Intellectual Property Policy Committee normally meets at least once a year and also at the discretion of the Deputy Vice-Chancellor (Research and Commercialisation).

Reporting

Intellectual Property Policy Committee reports to University Academic Board at least annually.
